Promises to Keep; The Canon of American Legal Thought

人文社會高等研究院與本校國家發展研究所及法律學院科技
、倫理與法律研究中心合辦專題講座,邀請美國哈佛大學法律學院貝克曼網路與社會中心(The Berkman Center for Internet and Society at Harvard Law School)主任William Fisher教授於97年1月21至本校舉辦專題演講。
  
William Fisher教授的研究專長為一般財產法、智慧財產權法及美國法律史;除其研究領域外,教授的科目包括專利法、網路法、智慧財產權的國際比較等。Fisher教授自1988年起即深入探討智慧財產權法的公平使用原則;1997年更將美國法律史的觀點導入智慧財產權方法學的討論。近年發表的專書著作有《美國法律思想教則(奇怪的翻譯:: canon通常指"正典"》(The Canon of American Legal Thought,與David Kennedy合著(應該是),2006,普林斯頓大學出版)、《應遵守的承諾:科技、法律、及娛樂的未來》(Promises to keep : technology, law, and the future of entertainment,2004,史丹佛大學出版)。此次邀請至臺大演講,機會實屬難得。歡迎校內外師生踴躍出席。演講訊息如下:

ラリーは寛大にもこのBlogを一週間ホストする機会を与えてくれた。わたしのプランは、この機会を主にエンターテインメント産業が現在迎えている 危機的転換点と、その危機に対処する魅力的かつ現実的な解決策を巡る議論を引き出すために使うことだ。わたしは最近この主題を扱った『Promises to Keep - Technology, Law, and the Future of Entertainment』を上梓した。全体の議論を概観する第一章と、最も議論の的となっている第六章はともにオンラインで読むことができる。本自体はどのオンライン書店でも購入可能だ。

まずは第一章の論旨を簡潔に要約してから、その議論が成立しうるか、特に最近の研究や動向を考慮に入れてもなお有効かどうかを問うことにしよう。

第一章の議論を簡単にまとめれば:三つの技術的進歩、すなわちデジタル録音・録画と格納システム、圧縮・展開システム、そしてインターネットの組み 合わせは、音楽や映像のレコードを作り、保持し、共有し、楽しむための劇的に新しい方法を生みだした。これら新技術の十分な活用は多くの社会的・経済的利 益をもたらす:大幅なコスト削減(消費者はより少ない費用でより多くの娯楽を、アーティストはより多くの収入を得られる)・流通の精度と利便性の向上・広 い範囲の聴衆に作品を届けることができ、妥当な収入を得られるミュージシャンや映画製作者の急激な増加・一般に入手可能な作品の多様化・文化が作られる過 程に参加する人口の劇的増加(わたしはこの傾向を“記号論的民主主義[semiotic democracy]”という用語で呼んでいる(わたしが考案した言葉ではない))。しかしこの技術的進歩は、同時に三つの深刻な危機も招く:アーティス トおよび中間業者がレコードから利益を得てきた伝統的システムの浸食・アーティストの“人格権”への脅威・われわれがみずからを規定する拠り所のひとつで ある文化的イコンの不安定化。章の結びとなる主張は、われわれは法的システムおよび関連するビジネスモデルの再構成によって、付随する害を最小化しつつ、 新技術によって作りだされた機会の活用に努めるべきであるというものだ。(以降の章は (a) われわれが現在までこうした目標の達成に失敗してきたことを論じ、(b) 達成するための方法をスケッチする)。

この危機に対処するため、わたしや他の人々が提案している個々の方法について触れる前に、この問題へのわたしの説明がはたして公正で中立かどうか問 うことは有益だろう。考えられる批判のひとつは、OberholzerとStrumpfによる最近の報告“The Effect of File Sharing on Music Sales”(http://www.unc.edu/~cigar/papers/FileSharing_March2004.pdf)を根拠とし て、新技術(この場合はP2Pサービス)が伝統的なビジネスモデルに及ぼしてきた脅威の規模が大幅に誇張されているというものだろう。また別の批判として ありうるのは、「人格権(moral rights)」(作品の一貫性を保ち、また適切なクレジットを受けたいというアーティストの要求)を大げさに扱いすぎている(全般的に、あるいは無限の 複製が可能なデジタル記録物について)というものだ。こうした批判、あるいは関連するどのような問題についても意見を聞きたいと思っている。

無関係な手続き上の点を2つ:まず、残念ながら、東部時間で月曜の1:00amから昼までは空路で移動中のためコメントに応えることができない。だ がそのあとはオンラインに復帰する予定だ。もう一点、今回の選挙の重要性や投票が間近に迫っていることから、今週の話題をオンライン・エンターテインメン トだけに限ることは不可能かもしれない。そのときはまた何か考えることになるだろう。
